Even though it is a fixed-term employment contract, you are required to provide at least one month's notice before the ending of the apprenticeship as to whether the apprentice will continue working in your salon or not. Also, you MUST treat your apprentice like any other employee, as they accrue the same entitlements, e.g. holiday/sick pay from DAY ONE! If the apprentice has not signed the training contract then they MUST be paid as a casual level 1 under the Award.

File Apprentice RTO Fee Reimbursement Agreement

However, if you are a small business with 15 or less employees and your casual has been employed for more than 12 months, they could lodge an unfair dismissal claim if no further shifts are provided.

File Part Time Letter of Engagement

A part-time employee is employed to work less than 38 hours per week. An employer and employee have to agree on a regular pattern of work when the employee starts. The agreement has to be in writing and include: (a) the hours worked each day; (b) the days of the week the employee will work; (c) the start and finish times each day; (d) that any change to the agreement will be in writing; (e) that the minimum daily hours is 3 hours (f) the times and length of meal breaks. The employer has to keep a copy of the agreement, and give a copy to the employee.
